American Medical Ass'n v. United Healthcare Corporation (S.D.N.Y.)

Pomerantz, as Co-Lead Counsel and Lead Settlement Counsel, obtained a $350 million settlement for a class of both out-of-network providers and subscribers.

The final fairness hearing was held on September 13, 2010. On September 20, 2010, the Court granted final approval of the proposed $350 million settlement. Final judgment was entered on October 5, 2010. Pursuant to the Court’s Order, all Class Members had until October 5, 2010 to file their claim form to be eligible to receive monies from the Settlement Fund. Class Members who, by October 5, submitted to Berdon Claims Administration a request for claims data also satisfied the filing deadline.

After its review of submitted claims, Berdon sent letters to all claimants who had deficiencies in their submissions that might be cured.  Claimants had an opportunity to provide further information as requested to remedy those deficiencies.

The Court signed the Final Distribution Order on February 3, 2012. Pursuant to the Order, any claims received by Berdon on or after the date of the Order are barred from receiving any distribution from the Net Settlement Fund. Mailing of claimants' checks representing their pro rata share of the Net Settlement Fund has begun and is expected to be completed by early April 2012.
