Chereskin v. Fidelity National Title Ins. Co (Nassau Co. Fla.); Grosso v. Fidelity National Title Ins. Co. (Broward Co. Fla.) -

Cases brought by two Plaintiffs represented by Pomerantz have been consolidated in the Circuit Court for Broward County after they successfully objected to an inadequate settlement proposed by other counsel representing another plaintiff in another Florida circuit.   Grosso v. Fidelity National Ins. Co., 983 So.2d 1165 (Fla. 3d DCA 2008), rev. denied, 2008 WL 519529 (Fla. Dec. 8, 2008).

As with other Pomerantz cases against First American Title Ins. Co. and Commonwealth Title Ins. Co. in Florida, the Plaintiffs in this case allege that Fidelity National unlawfully overcharged them and many other Floridians for title insurance premiums on refinance transactions, when Florida law and regulations required the title insurer to charge a discounted "reissue rate" premium because these Plaintiffs and many others already had owners’ title insurance policies on their properties.  Additional discovery of the title insurer’s practices and procedures is being taken in the Fidelity National case, in advance of a motion to certify the case as a class action.
