The Pomerantz Antitrust Practice

The Pomerantz firm is a leader in complex antitrust litigation. Antitrust actions focus on a wide variety of wrongful business practices which include price-fixing, attempted monopolization, and customer and market allocation. In its prosecution of antitrust class actions, the Pomerantz firm seeks recovery on behalf of individuals and businesses who have been financially injured by the defendants' anti-competitive conduct.

The Pomerantz firm has achieved a national reputation for its expertise in antitrust litigation. Indeed, the firm has served in a leadership role in numerous complex and high profile antitrust actions. The In re Salomon Brothers Treasury Litigation, in which the Pomerantz firm helped to recover a $100 million recovery on behalf of a class and several subclasses, is illustrative of the firm's practice. The defendants in this case included, among others, Salomon Inc, Steinhardt Partners, L.P., Michael Steinhardt, Luttrell Capital Management, Inc., and Paul W. Mozer. The plaintiffs charged defendants with manipulating or cornering the cash and financing markets for certain United States Treasury notes, which included coordinating purchases and sales of the notes in the cash market and bidding in the auction market, as well as squeezing of the repurchase financing market through use of "off-the-street" financing. As co-lead counsel in this action, the Pomerantz firm successfully navigated the extremely complex transactions and legal issues in this action, and achieved an excellent result for the plaintiffs.

Another notable case in which the Pomerantz firm played a prominent role, In re NASDAQ Market-Makers Antitrust Litigation, M.D.L. No. 1023 (S.D.N.Y. 1994), resulted in a settlement in excess of $1 billion for the plaintiffs. The firm played an active role in the Nasdaq case as counsel for the State of Louisiana and five of its retirement funds. The Pomerantz firm has achieved similar substantial recoveries in other antitrust actions. See for example, In re Sorbates Direct Purchaser Antitrust Litigation ($80 million settlement).

Other prominent antitrust cases handled by the firm include, In re Methionine Antitrust Litigation, a price-fixing action against four leading animal feed producers, and In re Mylan Antitrust Litigation, a price-fixing action involving the sale of anti-anxiety medications.
